Terms of Service

Last updated October 16, 2026

These Terms of Service (“Terms”) are an agreement between you and BLD (“BLD”, “we”, “us”), the operator of the BLD marketplace at bld.online and the BLD mobile apps. By accepting these Terms during onboarding, or by using the Service as a Client, you agree to be bound by them. If you do not agree, do not use the Service.

1.The BLD platform

1.1What BLD does

BLD is a managed marketplace that connects people and companies who need site survey work (“Clients”) with independent survey professionals (“Surveyors”). Services include laser scanning and LiDAR, land surveying, drone services, and 3D models and drawings such as Scan-to-BIM, Scan-to-CAD and as-built drawings.

1.2How it works for Clients

You prepare a project brief and post it on the Service. BLD may show you a project price before you post, or contact you about cost and matching after you post. When a price is shown and you accept it (on a company team, a member's project is accepted by the company's owner or an admin, as described in Section 3.1), that accepted price applies to the project. BLD then offers the project to suitable Surveyors near the site, and a Surveyor accepts or declines the offer. BLD manages the process between Client and Surveyor, including pricing, discounts and adjustments, and dispute handling, as described in these Terms.

1.3Access grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the BLD website and mobile apps (the “Service”) to request survey work for your own business purposes as a Client.

1.4Surveyors are independent

Surveyors are independent businesses, not employees, agents or partners of BLD. Surveyors decide how to perform their work and are responsible for it, including its quality, their people, subcontractors, equipment and methods. BLD manages the marketplace process but is not a party to the survey work, does not perform it, and does not guarantee workmanship or results, unless we expressly agree in writing to do so. Matching a project with a Surveyor is not an endorsement or guarantee of that Surveyor, and BLD does not guarantee that any Surveyor will accept your project or complete it by a particular date.

1.5Phase 1 and changes

BLD is in an early phase. Features, including payment features, may be offered free of charge, changed, added or withdrawn at any time, and free features come without support commitments. This does not reduce the confidentiality, security or data protection commitments in the Non-Disclosure Agreement, the Privacy Policy or the Data Processing Agreement.

2.Accounts and eligibility

2.1Who can use BLD

You must be at least 18 years old and able to form a binding contract. If you register a company account, you confirm that you are authorized to accept these Terms for that company, and “you” includes the company.

2.2Accurate information and verification

You must give accurate, current information and keep it up to date. Every account must verify a mobile number before using the marketplace. Company accounts must also verify a work email and provide a company address. People who join a company account through a team invite verify their email by opening the invite and act under that company account, so they don't complete these steps separately. Each email address, mobile number and company name may belong to only one account.

2.3Keeping your account secure

You are responsible for keeping your password and verification codes confidential and for all activity on your account, including activity by people you add to it. Do not share your login with anyone outside your organization. Tell us immediately at support@bld.online if you believe your account has been accessed without permission.

2.4Suspension

We may suspend or limit an account, without prior notice where reasonable, if we believe it breaches these Terms, puts other users at risk, or is used fraudulently.

3.Projects, pricing and work

3.1BLD-set pricing

BLD sets the price for each project from your brief. The Service may show that price before you post (posting then accepts it), or BLD may contact you about cost and matching and set or confirm the price afterward. When a price is shown in the Service, you can download a quote for it. If BLD adjusts the price before the project is confirmed, the Service shows you the new price, and the project is confirmed only after you accept it. On a company account, only the owner or an admin can accept a price; when a member posts a project, its price waits for the owner or an admin to accept it. You may not negotiate or change the price through the Service unless BLD allows it.

3.2Matching and offers

After you post a project, BLD offers it to suitable Surveyors. Offers to Surveyors are time-limited. If no Surveyor accepts, BLD may re-offer the project, adjust it with you, or cancel it. BLD does not guarantee that a Surveyor will accept, or how long a match will take.

3.3Confirmation is a commitment

A project is confirmed when a Surveyor has accepted it and you have accepted its current price. Confirmation is a commitment to the brief and that price, subject to Section 3.4 and Section 3.8.

3.4Changes to scope

If you materially change the scope, site, timeline or deliverables after a Surveyor accepts, BLD may re-price the project, adjust the schedule, or re-offer it. The Surveyor may decline the revised terms, in which case BLD may reassign the project.

3.5Review of Deliverables

Surveyors deliver the Deliverables through the Service. You must review them and tell BLD of any problem within the defined days of delivery, as set out in Section 9.

3.6Site access

You are responsible for arranging lawful site access and for telling BLD and the Surveyor about known hazards, site rules and security requirements. Delays caused by site access or missing information extend the schedule accordingly.

3.7Surveyor withdrawal and delays

If a Surveyor withdraws after accepting, misses the agreed schedule, or fails to deliver, BLD may reassign the project, adjust the schedule, or take other reasonable steps to complete it. BLD does not guarantee a completion date.

3.8Cancellation by you

If you cancel after a Surveyor accepts, BLD’s cancellation rules apply, which may include fees or compensation for work already done.

4.Your responsibilities as a Client

4.1Accurate briefs

Your project briefs, including the scope, site, timeline, access arrangements and required deliverables and tolerances, must be accurate and complete. Matching and pricing use this information.

4.2Rights to the site

You confirm that you own the site or have the authority to request the survey and to allow a Surveyor to access it. You must follow all laws and site rules that apply to your project.

4.3Surveyor information

Surveyor details you receive through BLD are confidential (see Section 12). You may use them only for the project they were shared for, and you must not use them to arrange work or payment outside BLD for projects introduced through BLD.

4.4Taxes and your business

You are responsible for the taxes that apply to you and for your own staff, contractors and business expenses.

5.Discounts and adjustments

5.1Price changes

BLD may apply discounts, credits, promotions or adjustments that change the amount charged to you or paid to a Surveyor, and may change or end them at any time. They are not an ongoing entitlement and do not set a precedent for future projects.

5.2Dispute-related adjustments

BLD may adjust a project’s price for changes in scope (see Section 3.4), delays, cancellations, or the outcome of a dispute under Section 9.

6.Fees and payments

Payment features are not yet live. Until they are, nothing in these Terms obliges you to pay through BLD, and any amounts shown are for display and matching only.

Before BLD charges you through the Service, we will show you the amount, timing, fees, tax requirements and refund rules, and you will need to agree to them. Unless stated otherwise, amounts are in U.S. dollars and exclude taxes. You are responsible for the taxes that apply to you.

7.Acceptable use

You must not, and must not help anyone else to:

  • reverse engineer, decompile or try to extract the source code or underlying structure of the Service, or bypass its security, rate limits or verification steps;
  • scrape, copy or bulk-download data, profiles or listings from the Service;
  • create accounts with false details, impersonate anyone, or misrepresent your identity or authority;
  • post a project for a site you have no right to survey or provide access to;
  • misuse Surveyor information or arrange work or payment outside BLD, as set out in Section 4.3;
  • post unlawful, misleading, infringing or harmful content, or send spam;
  • harass, threaten or discriminate against other users or our staff; or
  • resell, sublicense or provide the Service to third parties as a service bureau.

8.Your content and deliverables

8.1Ownership of your content

You keep ownership of the content you submit, including project briefs, drawings, photos, files and messages (“Project Content”).

8.2License to operate the Service

You grant BLD a non-exclusive, royalty-free license to host, copy, process, display and share your Project Content only as needed to run the Service, and as described in Section 8.5. For example, we share your project brief, site location and files with the Surveyors the project is offered to, and, once a Surveyor accepts, the details needed to perform the work. We may also create aggregated, de-identified statistics that do not identify you or any individual, and use them to operate and improve BLD.

8.3Deliverables

Point clouds, models, drawings and other outputs Surveyors deliver for your project (“Deliverables”) are delivered through BLD. Unless otherwise agreed in writing, ownership of the Deliverables passes to you once the project is completed and, once payment features are live, paid for in full.

8.4BLD’s intellectual property

The Service, the BLD names and logos, and our software, designs and documentation belong to BLD. No rights are granted except those expressly stated in these Terms.

8.5AI and model improvement

BLD may use de-identified Project Content and Deliverables to develop, train and improve BLD’s matching, pricing and survey-processing tools. Before use, BLD removes names, contact details, exact site addresses and other information that identifies a person or a site. BLD does not use Project Content to train models that are made available to other companies, does not sell it, and does not use personal data in it for this purpose. This Section does not reduce the confidentiality commitments in the Non-Disclosure Agreement.

9.Disputes

9.1BLD manages disputes

If you or a Surveyor has a problem with a project (for example, scope, quality, delay, cancellation or non-delivery), either may raise it with BLD through the help desk or at support@bld.online within defined days of delivery or the event.

9.2Process

You will provide the information and evidence BLD reasonably requests, such as photos, records and messages, within the time we set. BLD may review the evidence, ask for corrections or rework, adjust the price, issue credits or refunds, reassign the project, or take other reasonable steps to resolve the dispute.

9.3Effect of BLD’s decision

BLD’s decision is final for purposes of the BLD platform, including prices, credits, ratings and account status. It does not limit any legal rights you may have against the Surveyor outside the Service, except as these Terms say otherwise. BLD does not guarantee any outcome.

9.4Role of BLD

BLD manages the process described in this Section as set out in Section 1.4.

10.Ratings and feedback

After completed work, Clients and Surveyors may rate each other. Ratings must be honest and based on real experience with that project. We may remove ratings or reviews that are abusive, fraudulent or unrelated to the work. If you send us suggestions or feedback about BLD, we may use them freely to improve our products without any obligation to you.

11.Third-party services

The Service uses or links to third-party services such as Google sign-in, maps, address search and Street View. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services. The providers that process data for us are listed on our Sub-processors page.

12.Confidentiality and personal data

12.1Confidentiality

Surveyor details, pricing and other users’ personal data that you receive through BLD are confidential. You agree to the Non-Disclosure Agreement, which forms part of these Terms.

12.2Personal data in your projects

Your Project Content may include personal data, such as names and contact details of site contacts and occupants. You confirm that you have the right to share it through BLD, that you have given any notices and obtained any consents the law requires, and that BLD may share it with the Surveyors your project is offered to.

12.3Data Processing Agreement

The Data Processing Agreement forms part of these Terms and applies when BLD processes personal data in your Project Content on your behalf. You accept it with these Terms. BLD does not use personal data in your Project Content for model training, as set out in Section 8.5. Our handling of other personal data is described in the Privacy Policy.

13.Disclaimers

Deliverables reflect site conditions on the date of capture. Stated accuracy or tolerance levels are professional estimates, not guarantees, and real-world variance depends on the size and complexity of the space. Deliverables do not replace structural, MEP, architectural or other professional design services. Appropriate professional review and approval, and compliance with permitting and other legal requirements, are needed before using Deliverables for construction.

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”. BLD disclaims all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement, and does not warrant that the Service will be uninterrupted, secure or error-free, that any Surveyor will accept your project or complete it by a particular date, or that any Surveyor or Deliverable will meet your expectations.

14.Limitation of liability

To the maximum extent permitted by law, BLD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or related to the Service, even if advised of their possibility.

Our total liability for all claims relating to the Service is limited to the fees you paid to BLD in the twelve months before the claim.

BLD manages pricing and dispute processes as described in these Terms, but is not liable for the acts, omissions or conduct of Surveyors, except to the extent liability cannot be excluded by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15.Indemnification

You will defend, indemnify and hold harmless BLD and its officers, employees and agents from third-party claims, losses and reasonable legal fees arising from your Project Content, your rights to the site and the personal data you share, your use of the Service in breach of these Terms, or your violation of any law or third-party right.

16.Term and termination

These Terms apply while you have an account or use the Service. You may stop using BLD at any time and ask us to delete your account through the help desk or at support@bld.online. We may suspend or end your access if you breach these Terms or if we stop offering the Service.

Ending your account does not cancel commitments already made on confirmed projects. Personal data in your Project Content is deleted as set out in the Data Processing Agreement. Sections on pricing adjustments, fees owed, disputes, content licenses, confidentiality, disclaimers, limitation of liability, indemnification and general terms survive termination.

17.Changes to these Terms

We may update these Terms. When we make material changes, we will update the date above and notify you by email or in the app. If you continue to use the Service after the changes take effect, you accept the updated Terms. Before any paid feature goes live, we will ask you to review and accept the payment terms for it.

18.General

18.1Governing law

These Terms are governed by the laws of the jurisdiction in which BLD is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction, unless mandatory local law gives you the right to bring a claim elsewhere.

18.2Force majeure

Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, severe weather, epidemics, war, labor disputes, or failures of utilities, networks or hosting providers.

18.3Assignment

You may not transfer these Terms without our written consent. We may transfer them to an affiliate or to a successor in a merger, acquisition or sale of assets.

18.4Notices

We send notices to the email address or mobile number on your account, or in the app. You can send notices to support@bld.online.

18.5Entire agreement

These Terms, together with the Privacy Policy, the Non-Disclosure Agreement, the Data Processing Agreement and any written order agreed with BLD, are the entire agreement between you and BLD about the Service. If any provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.
