Terms of Service
Last updated October 16, 2026
These Terms of Service (“Terms”) are an agreement between you and BLD (“BLD”, “we”, “us”), the operator of the BLD marketplace at bld.online and the BLD mobile apps. By accepting these Terms during onboarding, or by using the Service as a Surveyor, you agree to be bound by them. If you do not agree, do not use the Service.
1.The BLD platform
1.1What BLD does
BLD is a managed marketplace that connects people and companies who need site survey work (“Clients”) with independent survey professionals (“Surveyors”). Services include laser scanning and LiDAR, land surveying, drone services, and 3D models and drawings such as Scan-to-BIM, Scan-to-CAD and as-built drawings.
1.2How it works for Surveyors
Clients post project briefs at a price set by BLD. BLD offers each project to suitable Surveyors near the site. When a payout is ready, the offer shows it; you accept or decline the offer. BLD manages the process between Client and Surveyor, including pricing, discounts and adjustments, and dispute handling, as described in these Terms.
1.3Access grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the BLD website and mobile apps (the “Service”) for your own business purposes as a Surveyor.
1.4You are independent
You are an independent business, not an employee, agent or partner of BLD. You decide how to perform your work and are responsible for it, including its quality, your people, subcontractors, equipment and methods. BLD manages the marketplace process but is not a party to the survey work, does not perform it, and does not guarantee workmanship or results, unless we expressly agree in writing to do so. Matching a project with you is not an endorsement or guarantee of you, and being offered a project is not a guarantee of future offers.
1.5Phase 1 and changes
BLD is in an early phase. Features, including payment features, may be offered free of charge, changed, added or withdrawn at any time, and free features come without support commitments. This does not reduce the confidentiality, security or data protection commitments in the Non-Disclosure Agreement, the Privacy Policy or the Data Processing Agreement.
2.Accounts and eligibility
2.1Who can use BLD
You must be at least 18 years old and able to form a binding contract. If you register a company account, you confirm that you are authorized to accept these Terms for that company, and “you” includes the company.
2.2Accurate information and verification
You must give accurate, current information and keep it up to date. Every account must verify a mobile number before using the marketplace. Company accounts must also verify a work email and provide a company address. Each email address, mobile number and company name may belong to only one account.
2.3Keeping your account secure
You are responsible for keeping your password and verification codes confidential and for all activity on your account. Do not share your login with anyone outside your organization. Tell us immediately at support@bld.online if you believe your account has been accessed without permission.
2.4Suspension
We may suspend or limit an account, without prior notice where reasonable, if we believe it breaches these Terms, puts other users at risk, or is used fraudulently.
3.Offers, pricing and work
3.1BLD-set pricing
BLD sets the price for each project. When a payout is ready, the offer shows it for the project, after BLD’s commission, before you accept. If BLD adjusts the price before the project is confirmed, the Service shows you the updated payout. You may not negotiate or change the payout through the Service unless BLD allows it.
3.2Offers expire
Offers are time-limited and expire if not answered in time. Declining carries no penalty, but repeated unanswered offers may affect how often you are matched. Consecutive unanswered offers may reduce your matching priority.
3.3Acceptance is a commitment
Accepting an offer is a commitment to perform the work as described in the brief, for the payout shown, or as later agreed through BLD, subject to Section 3.4. The project is confirmed once the Client has accepted its current price, and commission applies as set out in Section 6.
3.4Changes to scope
If the Client materially changes the scope, site, timeline or deliverables after you accept, BLD may re-price the project, adjust the schedule, or re-offer it. You may accept or decline the revised terms and are not required to continue on materially changed terms.
3.5Performance standards
You must perform accepted work in a professional and workmanlike manner and meet the agreed schedule. You must tell BLD promptly through the Service about delays, access problems or hazards. You must deliver complete Deliverables, in the formats and to the tolerances stated in the brief, through the Service.
3.6Site access
Clients are responsible for arranging lawful site access and telling you about known hazards. Delays caused by site access or missing information extend the schedule accordingly. You remain responsible for following site rules and for your own safety and that of your team on site.
3.7Withdrawal and no-shows
If you withdraw after accepting, miss the agreed schedule without good reason, or fail to deliver, BLD may reassign the project, reduce your matching priority, or suspend your account. Once payment features are live, BLD may also adjust or withhold amounts that would otherwise be due.
3.8Cancellation by the Client
If a Client cancels after you accept, BLD’s cancellation rules apply, which may include adjustments or compensation for work already done.
4.Your responsibilities as a Surveyor
4.1Portfolio accuracy
Your portfolio, including services, coverage area, equipment, experience, rates and insurance, must be accurate and kept current. Matching uses this information, and a portfolio must be complete before you can receive offers.
4.2Licenses, insurance and compliance
You are responsible for holding and maintaining every license, certification, registration and insurance policy your work requires, including professional land surveying licensure where applicable, drone pilot certification and airspace authorizations, and general liability insurance. You must follow all laws and site rules that apply to your work, including health and safety requirements.
4.3Client information
Site details, drawings, files and Client contact details are confidential (see Section 12). You may use them only for the project they were shared for, and you must not use them to arrange work or payment outside BLD for projects introduced through BLD.
4.4Taxes and your business
You are responsible for your own taxes, staff, subcontractors, equipment and business expenses.
5.Discounts and adjustments
5.1Price changes
BLD may apply discounts, credits, promotions or adjustments that change the amount offered or paid to you or to the Client, and may change or end them at any time. They are not an ongoing entitlement and do not set a precedent for future projects.
5.2Dispute-related adjustments
BLD may adjust a project’s price for changes in scope (see Section 3.4), delays, cancellations, or the outcome of a dispute under Section 9.
6.Commission and payments
BLD charges Surveyors a commission on projects completed through the Service. Each offer shows the commission rate and your payout after commission before you accept, and the rate shown when you accept applies to that project. BLD may change the rate for future projects with notice under Section 17, but a change does not affect projects you have already accepted.
Payment features are not yet live. Until they are, nothing in these Terms obliges you to accept or receive payment through BLD, and any amounts shown are for display and matching only.
Before BLD pays you through the Service, we will show you the payout amount after commission, timing, fees, tax requirements and any holdbacks or reversals, and you will need to agree to them. Unless stated otherwise, amounts are in U.S. dollars and exclude taxes. You are responsible for the taxes that apply to you.
7.Acceptable use
You must not, and must not help anyone else to:
- reverse engineer, decompile or try to extract the source code or underlying structure of the Service, or bypass its security, rate limits or verification steps;
- scrape, copy or bulk-download data, profiles or listings from the Service;
- create accounts with false details, impersonate anyone, or misrepresent your qualifications;
- misuse Client information or arrange work or payment outside BLD, as set out in Section 4.3;
- post unlawful, misleading, infringing or harmful content, or send spam;
- harass, threaten or discriminate against other users or our staff; or
- resell, sublicense or provide the Service to third parties as a service bureau.
8.Your content and deliverables
8.1Ownership of your content
You keep ownership of the content you submit, including portfolio material, scans, photos, drawings and messages (“User Content”).
8.2License to operate the Service
You grant BLD a non-exclusive, royalty-free license to host, copy, process, display and share your User Content only as needed to run the Service. For example, we show your portfolio details to Clients and, once you accept a project, share the Deliverables you submit with the Client. We may also create aggregated, de-identified statistics that do not identify you or any individual, and use them to operate and improve BLD.
8.3Deliverables
Point clouds, models, drawings and other outputs you deliver for a project (“Deliverables”) are delivered through BLD. Unless otherwise agreed in writing, ownership of the Deliverables passes to the Client once the project is completed and, once payment features are live, paid for in full. Subject to the Non-Disclosure Agreement, you may keep a copy only where the law or professional record-keeping rules require it. You may show non-confidential samples in your portfolio only with the Client’s written permission.
8.4BLD’s intellectual property
The Service, the BLD names and logos, and our software, designs and documentation belong to BLD. No rights are granted except those expressly stated in these Terms.
9.Disputes
9.1BLD manages disputes
If you or a Client has a problem with a project (for example, scope, quality, delay, cancellation or non-delivery), either may raise it with BLD through the help desk or at support@bld.online within defined days of delivery or the event.
9.2Process
You will provide the information and evidence BLD reasonably requests, such as scans, photos, records and messages, within the time we set. BLD may review the evidence, ask for corrections or rework, adjust the price, issue credits, reassign the project, or take other reasonable steps to resolve the dispute.
9.3Effect of BLD’s decision
BLD’s decision is final for purposes of the BLD platform, including prices, credits, ratings and account status. It does not limit any legal rights you may have against the Client outside the Service, except as these Terms say otherwise. BLD does not guarantee any outcome.
9.4Role of BLD
BLD manages the process described in this Section as set out in Section 1.4.
10.Ratings and feedback
After completed work, Clients and Surveyors may rate each other. Ratings must be honest and based on real experience with that project. We may remove ratings or reviews that are abusive, fraudulent or unrelated to the work. If you send us suggestions or feedback about BLD, we may use them freely to improve our products without any obligation to you.
11.Third-party services
The Service uses or links to third-party services such as Google sign-in, maps, address search and Street View. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services. The providers that process data for us are listed on our Sub-processors page.
12.Confidentiality and personal data
12.1Confidentiality
Project briefs, site addresses, drawings, scans, pricing and other users’ personal data that you receive through BLD are confidential. You agree to the Non-Disclosure Agreement, which forms part of these Terms.
12.2Personal data you receive
Personal data you receive through BLD, such as names and contact details of site contacts and occupants, is Confidential Information under the Non-Disclosure Agreement. You must also follow the privacy laws that apply to you when handling it.
12.3BLD’s handling of personal data
Our handling of personal data is described in the Privacy Policy and, for business customers (Clients), the Data Processing Agreement. The Data Processing Agreement is not a document you accept as a Surveyor.
13.Disclaimers
Deliverables reflect site conditions on the date of capture. Stated accuracy or tolerance levels are professional estimates, not guarantees, and real-world variance depends on the size and complexity of the space. Deliverables do not replace structural, MEP, architectural or other professional design services. Appropriate professional review and approval, and compliance with permitting and other legal requirements, are needed before using Deliverables for construction.
Except as expressly stated in these Terms, the Service is provided “as is” and “as available”. BLD disclaims all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement, and does not warrant that the Service will be uninterrupted, secure or error-free, that you will receive any particular number of offers or amount of work, or that any Client will meet your expectations.
14.Limitation of liability
To the maximum extent permitted by law, BLD will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from or related to the Service, even if advised of their possibility.
Our total liability for all claims relating to the Service is limited to the commission and fees you paid to BLD, or that BLD deducted from your payouts, in the twelve months before the claim.
BLD manages pricing and dispute processes as described in these Terms, but is not liable for the acts, omissions or conduct of Clients, except to the extent liability cannot be excluded by law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15.Indemnification
You will defend, indemnify and hold harmless BLD and its officers, employees and agents from third-party claims, losses and reasonable legal fees arising from your User Content, your use of the Service in breach of these Terms, work you perform through BLD, or your violation of any law or third-party right.
16.Term and termination
These Terms apply while you have an account or use the Service. You may stop using BLD at any time and ask us to delete your account through the help desk or at support@bld.online. We may suspend or end your access if you breach these Terms or if we stop offering the Service.
Ending your account does not cancel commitments already made on accepted projects. When a project ends or your account closes, you must return or delete Client information as required by the Non-Disclosure Agreement. Sections on pricing adjustments, disputes, content licenses, confidentiality, disclaimers, limitation of liability, indemnification and general terms survive termination.
17.Changes to these Terms
We may update these Terms. When we make material changes, we will update the date above and notify you by email or in the app. If you continue to use the Service after the changes take effect, you accept the updated Terms. Before any paid feature goes live, we will ask you to review and accept the payment terms for it.
18.General
18.1Governing law
These Terms are governed by the laws of the jurisdiction in which BLD is organized, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction, unless mandatory local law gives you the right to bring a claim elsewhere.
18.2Force majeure
Neither party is liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, severe weather, epidemics, war, labor disputes, or failures of utilities, networks or hosting providers.
18.3Assignment
You may not transfer these Terms without our written consent. We may transfer them to an affiliate or to a successor in a merger, acquisition or sale of assets.
18.4Notices
We send notices to the email address or mobile number on your account, or in the app. You can send notices to support@bld.online.
18.5Entire agreement
These Terms, together with the Privacy Policy, the Non-Disclosure Agreement and any written order agreed with BLD, are the entire agreement between you and BLD about the Service. If any provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it. Nothing in these Terms creates a partnership, joint venture, agency or employment relationship.
